The module provides an understanding of the principles of construction laws and its applications. By understanding the basic principle of construction law, the importance of adhering to the specific procedures and notices are emphasized. The next phase is to develop an in-depth knowledge on the application of the law and the remedies available to the parties. Subsequently, students will be able to adopt a systematic approach to analyze disputes and the respective liabilities. Lastly, this module focuses to enhance the students’ knowledge on matters involving contractual claims and its assessment.
We were required to give a sound professional advice to a client who has embarked on a project and had some problems in the post contract stage. Based on the situation given, we were required to write a report to advise either the contractor or the employer/client about:
a) The general principle governing main contractor’s responsibilities in executing construction contracts
b) The conditions guiding payment in the FIDIC Red Book 1999 conditions of contract
c) Their contractual standing in terms of conditions governing contractual programme in the FIDIC Red Book 1999 conditions of contract
d) The principles guiding testing and defects in construction contracts in the FIDIC Red Book 1999 conditions of contract
e) Dispute resolution methods that can be used to resolve the problem in the FIDIC Red Book 1999 conditions of contract

Furthermore, we were also required to have a separate analysis section where compare the advice that we given based on the FIDIC Red Book condition of contract with the PAM Contract 2006 or JKR 203 form of contract.

Learning Outcome:
In this assignment, I was able to put theories that I learnt during lectures and tutorials into implementation as I am
able to understand the two standard forms of conditions of contract such as PAM Form 2006 (widely used in the
Malaysian private construction industry) and FIDIC Contract (international construction contracts) and apply it in
different circumstances in order to resolve the dispute and prevent any miscommunication and conflicts between each
other. Not only that, we also learnt the principles of construction laws and its applications such as construction claims, variations, law relating to payments, Alternative Dispute Resolution and CIPAA 2012.

Moreover,this assignment help us to develop and reinforce our thinking and problem solving skills thinking critically in order for us to overcome each hurdles that we faced while accomplishing the project.When we face the difficult things or problem,we can able to solve it.
Communication is the necessity for this assignment because this is a group assignment, we need to
communicate with other group member and discuss the details of the project. It can improve our
communicated skills and promote our relationship.
